Income tax rates by 1 January 2015

On December 30, 2014, the Ministry of Finance of Turkey has published the new income tax rates as follows:
Up to 12,000 TRL: 15%;
From 12,001 through 29,000 TRL 20%;
From 29,001 – 106,000 TRL 27%;
From 106,001 TRL 35%.
Taxation follows a system where the higher taxation starts from the next amount determined by the Ministry of-
Finance.

Turkey signs Protocol No. 16 to the Convention for the Protection of Human Rights and Fundamental Freedoms

Under this Protocol No. 16 to the Convention, highest courts and tribunals of a High Contracting Party, as specified in accordance with Article 10, may request the Court to give advisory opinions on questions of principle relating to the interpretation or application of the rights and freedoms defined in the Convention or the protocols thereto. Turkey is the ninth country to sign this rather new instrument. No ratification is reported yet, ten ratifications are necessary for entering into force.

Turkey: Constitutional Complaint and the European Court of Human Rights

The European Court of Human Rights (ECHR) has recently declared inadmissible an application of a Turkish citizen against Turkey (Uzun vs. Turkey) for the reason that remedies had not been exhausted under Article 35 of the European Convention. The Court held that all claims where judgments of the Court of Cassation had not been finalized before September 23, 2012, were subject to the "individual application to the Constitutional Court" of Turkey. This remedy constitutes, according to the ECHR, an appropriate and easily accessible domestic remedy to be made use of before choosing the application under the ECHR.

6th Administrative Court Istanbul and the Gezi-Park

On the objection submitted by the Ministry of Culture against the preliminary injunction stopping the construction works at the Gezi-Park in Istanbul, the 6th Administrative Court of Istanbul upholds its decision.

Turkey: Constitutional Court on the period of detention

The Turkish Constitutional Court made a ruling on six individual applications where detainees complained of excess of the statutory detention period which must not exceed five years. In four cases the Court accepted the applications expressly abandoning the principle of exhaustion of all legal remedies.

Turkey: Old joint stock companies under the new Code of Commerce

Joint Stock Companies (Anonim Sirket) established earlier than 1st July 2012, adapt their Articles of Association to the regulations of the new Code of Commerce. The deadline for doing this has been postponed to July 1, 2014.
